Rental Agreement & Terms

RENTAL AGREEMENT, ASSUMPTION OF RISK, AND GENERAL RELEASE
1. Definitions
1.1 “Company” means The Bounce House People LLC, including its owners, officers, employees, contractors, representatives, and agents.
1.2 “Customer” means the individual(s) renting the equipment, signing this Agreement, or responsible for the rental, and all participants, minors, guests, or users under Customer’s supervision.
1.3 “Equipment” means all inflatables, games, slides, concessions, blowers, generators, tables, chairs, cords, anchors, and any other rental items provided by Company.
2. Equipment Rental, Payment, and Term
2.1 Customer rents the Equipment listed on the invoice.
2.2 Full payment is required prior to delivery unless otherwise agreed in writing.
2.3 The rental term begins at physical delivery and ends at physical pickup by Company.
2.4 Once delivered, Customer is not entitled to any refund except under the cancellation policies set forth herein.
2.5 If Equipment is inaccessible or unavailable for pickup at the designated time, Customer may be charged additional rental fees, recovery expenses, or the full replacement value of the Equipment.
3. Operation and Electrical Requirements
3.1 Customer must supply one (1) dedicated 115-volt, 20-amp outlet per blower located within fifty (50) feet of the setup location.
3.2 Only electrical cords supplied by Company may be used.
3.3 No third-party generators or extension cords may be used unless expressly approved by Company.
3.4 Customer is responsible for all service call fees resulting from inadequate or improper electrical supply.
3.5 In the event of deflation, Customer must immediately remove all users and check power supply, cord connections, blower intake, and air tubes.
4. Weather Policy
4.1 Company may cancel or reschedule a rental prior to delivery due to unsafe weather conditions.
4.2 Severe weather includes, but is not limited to, high winds, lightning, thunder, heavy rain, and extreme heat.
4.3 During severe weather, Customer shall immediately discontinue use, unplug the blower, and allow the Equipment to deflate.
4.4 If Company removes Equipment early for safety, Customer may reschedule within thirty (30) days. No refund will be issued.
5. Underground Utilities, Irrigation, and Property Damage
5.1 Equipment may require anchoring with stakes or sandbags.
5.2 Stakes may penetrate several inches into the ground.
5.3 Company shall not be responsible for any damage to sprinkler systems, irrigation lines, plumbing, electrical wiring, cable lines, communication lines, septic systems, drainage systems, or any underground utility.
5.4 Customer is solely responsible for identifying and marking all underground utilities or systems before setup.
5.5 Customer shall ensure that all irrigation and sprinkler systems remain fully turned off for the entire rental period and for at least twenty-four (24) hours prior to setup. Customer assumes full responsibility for any damage caused by irrigation, watering systems, wet ground, or soil saturation.
5.6 Customer shall ensure that all lawn mowing, edging, weed-whacking, or other lawn service is completed no less than forty-eight (48) hours prior to setup. No mowing or lawn maintenance shall occur during setup, during the rental period, or until the Equipment has been removed. Violation may result in cancellation without refund and additional fees.
5.7 Customer shall indemnify and hold harmless Company for any damage caused by ground conditions, irrigation systems, lawn services, or underground utilities.
5.8 Customer acknowledges that inflatable equipment, mats, tarps, and anchoring systems may cause temporary or permanent discoloration, browning, dying, or other impact to grass due to weight, pressure, heat, shade, moisture retention, or lack of sunlight. Company is not responsible for any grass discoloration or lawn damage resulting from placement or use of the Equipment.
6. Care, Misuse, and Fees
6.1 Customer is responsible for all damage not caused by ordinary wear and tear.
6.2 Damage includes, but is not limited to, cuts, tears, punctures, pet damage, spills, mud, gum, glitter, confetti, Orbeez, gel blasters, soap, oils, misuse, improper operation, or failure to deflate during unsafe weather.
Fee Schedule:
(a) Spilled food, drinks, or foreign substances: $50
(b) Excessive cleaning: $50
(c) Negligence-related damage: Full repair cost
(d) Damage beyond repair: Full replacement cost
(e) Returned check: $75
6.3 Any use of silly string or dye-based products shall result in a mandatory $500 fee due to permanent damage to inflatables.
7. Possession, Theft, and Return
7.1 Customer’s possession of the Equipment begins at delivery and ends at pickup.
7.2 Customer may not move, relocate, sublease, or alter the Equipment.
7.3 If Equipment is missing, stolen, or inaccessible, Customer is liable for full replacement and recovery costs.
8. Surface Requirements
8.1 Equipment must be installed on a flat, level, unobstructed surface.
8.2 Acceptable surfaces include grass (stakes permitted), concrete, asphalt, or indoor flooring (sandbags only).
8.3 Equipment shall not be installed on rocks, gravel, bricks, glass, sharp surfaces, slopes, loose sand, mud, saturated soil, or over any exposed utility or irrigation access point.
8.4 Company retains sole and final authority to determine whether a surface is safe for installation.
8.5 Equipment may not be moved by Customer after installation.
9. Prohibited Uses
Customer shall not permit climbing on walls, roofs, or sides; flips; wrestling; rough play; shoes; sharp objects; pets; food; drinks; gum; or water on dry units unless authorized.
10. Supervision
A competent adult eighteen (18) years of age or older must supervise the Equipment at all times and enforce all rules.
11. Overnight Rentals
Overnight rentals must be approved in writing.
Customer must deflate Equipment and store blowers indoors when not in use.
12. Malfunctions
Customer shall cease all use immediately upon malfunction and notify Company.
Failure to notify Company voids refund eligibility.
13. Cancellation and Refund Policy
13.1 Refunds are issued only for cancellations due to inclement weather occurring before delivery.
13.2 Weather cancellations must be received before 8:00 AM on the day prior to the event and must be at least twenty-four (24) hours before the scheduled event time.
13.3 Customer is solely responsible for verifying that the Equipment fits in the designated space. If the Equipment does not fit upon arrival, no refund shall be issued.
13.4 Optional pre-site inspection is available for a non-refundable fee of $50.
13.5 No refunds are issued for personal cancellations, illness, yard conditions, access issues, venue restrictions, or cancellations made within twenty-four (24) hours of the event.
14. Assumption of Risk and Release of Liability
Customer acknowledges that the use of inflatable equipment involves inherent risks including, but not limited to, falls, collisions, emotional distress, serious injury, or death.
Customer assumes all risks associated with use of the Equipment and agrees to release, indemnify, and hold harmless Company from all claims, liabilities, actions, damages, and attorney fees arising from use of the Equipment.
15. Participant Rules
Customer is responsible for enforcing all rules and ensuring age and size compatibility among users.
16. Attorney Fees
Customer agrees to pay all attorney fees, court costs, and collection costs incurred by Company in enforcing this Agreement.
17. Acknowledgment and Agreement
17.1 Customer affirms having read and understood this Agreement.
17.2 Payment of any deposit, partial payment, or reservation fee constitutes full acceptance of all terms in this Agreement, regardless of whether the Agreement has been signed.
17.3 Customer agrees voluntarily and accepts responsibility for all participants and property.
17.4 This Agreement is binding upon Customer, heirs, assigns, minors, guests, and any user of the Equipment.
